These Terms of Service ("Terms") govern your access to and use of the Smith Insuratech LLC lead marketplace platform (the "Platform"). By creating an account or using the Platform, you agree to these Terms, the Lead Purchase & License Agreement, and the Privacy Policy. If you do not agree, do not use the Platform.
You must be at least 18 years old, a duly licensed insurance agent in the jurisdictions where you operate, and located in the United States. You agree to provide accurate account information, to keep your login credentials and two-factor codes confidential, and to be responsible for all activity under your account. One account per person.
The Platform lets licensed agents browse, purchase, and receive insurance leads and manage those leads (including recording dispositions). Purchases of leads are governed by the separate Lead Purchase & License Agreement, which is incorporated by reference.
You will not: (a) resell, share, scrape, or redistribute leads or platform data; (b) access the Platform by any automated means or attempt to circumvent security or access controls; (c) upload malicious code; (d) use the Platform for any unlawful purpose; or (e) misrepresent your identity, licensing, or eligibility.
Payments are processed by our third-party payment processor (Stripe). Applicable taxes and processing fees are added at checkout. All lead purchases are final and non-refundable as described in the Lead Purchase & License Agreement. Chargebacks are prohibited and constitute a material breach.
You are solely responsible for your use of any leads and for complying with all applicable laws, including the TCPA, Do-Not-Call rules, and insurance regulations. See the Lead Purchase & License Agreement for full compliance and indemnification terms.
The Platform, its software, and its branding are owned by Smith Insuratech LLC and its licensors. Except for the limited license to use purchased leads, no rights are granted to you.
The Platform and all leads are provided "AS IS" without warranties of any kind. To the maximum extent permitted by law, Smith Insuratech LLC is not liable for indirect, incidental, special, consequential, or punitive damages, and its total liability is limited as set out in the Lead Purchase & License Agreement.
We may suspend or terminate your access at any time for violation of these Terms or the Lead Purchase & License Agreement, or to protect the Platform or third parties.
Disputes are subject to binding individual arbitration and a class-action waiver, governed by the laws of Florida, as set out in the Lead Purchase & License Agreement.
We may update these Terms from time to time. Material changes will require re-acceptance. Continued use after an update constitutes acceptance.
